The state of Kentucky takes the issue of DUIs very seriously. When someone is arrested and charged, they can expect harsh penalties and punitive measures.

However, as time has evolved, so have the courts. An example of that is the establishment of specialized DUI courts, which aim to provide an alternative to traditional punishments for individuals with DUI offenses.

What are DUI Courts?

DUI Courts, also known as Drug Courts or Specialized Treatment Courts are designed to address the underlying issues that often contribute to substance abuse and impaired driving. The focus of Drug Court is rehabilitation rather than punishment.

Participants enter a structured program that includes treatment for alcohol and drug dependency, regular court monitoring and more. All to address the root cause of the behavior so the individual can regain their life.

Does Kentucky have DUI Courts?

Yes. Kentucky has DUI Courts, but their availability varies from county to county. The Kentucky Administrative Office of the Courts (AOC) oversees the implementation of the programs within courts.

It is important to note that not everyone qualifies for drug court, and it is also essential to state that drug court is not a get-out-of-jail-free card.

Drug Courts are challenging, sometimes harder than some of the punishments that people who are convicted of drug crimes receive, because participants are being treated for issues like trauma and other psychological reasons underlying the impaired driving, which can bring up all kinds of difficult emotions.

While Drug Courts are challenging, they present an opportunity for some offenders to address the complexity of substance abuse and addiction by focusing on rehabilitation. These courts aim to reduce the number of repeat offenses and foster healthier, safer communities.
