The process for expungement in Kentucky involves multiple steps. You must obtain an expungement certification, which shows that you are eligible for expungement. What does expungement mean in Kentucky?

Expungement in Kentucky legally removes a record of an arrest, charge, or conviction so that—on most official background checks—it no record exists. If an expungement is granted, individuals may lawfully say it never happened for many purposes, such as employment or applying for credit.

When is an expungement automatic?

If a case is acquitted or dismissed with prejudice on or after July 15, 2020, it is automatically expunged 30 days later—no filing required (except traffic-related cases). Affected parties will receive notice, and relevant agencies are informed.

When can I petition for expungement after a dismissal or failure to indict?
  • Dismissal without prejudice
    • Misdemeanors: Eligible 1 year after dismissal, with no filing fee.
    • Felonies: Eligible 3 years after dismissal, with no filing fee
    Failure to indict (felony): If you're charged in District Court but not indicted within 6 months, you’re eligible after 6 months, with no filing fee.
  • What about eligibility after a conviction (misdemeanor or Class D felony)?
  • Misdemeanors: You must wait 5 years after completing your sentence and any enhancement period, with 5 years of good behavior and no new convictions.
  • Class D Felonies: Eligible 5 years after completing your sentence, probation, or parole—whichever is later—plus 5 years of no new convictions.
  • Exceptions: Certain offenses—like sex crimes or crimes against children—are not eligible for expungement.
  • What’s the process for expunging a conviction?
    1. Obtain a Certificate of Eligibility from the Kentucky Administrative Office of the Courts. This requires a background check by the Kentucky State Police and AOC, taking up to 60 days and costing $40.
    2. File the petition with the circuit court clerk where the conviction occurred, using the correct form.
    3. The prosecutor may object within 60 days. If there’s no objection, the court may approve the expungement without a hearing; if there’s an objection, a hearing will be held.
    4. If the judge approves the expungement and all fees are paid, the court and relevant agencies must remove the record from public view.

    Costs: Total fee is $300—$50 non-refundable up-front, with $250 due upon approval. Payment plans may be allowed.
